1. Acceptance of Terms

By accessing or using Evergreen State Roleplay, you confirm that you have read, understood, and agreed to these Terms of Service, our server rules, and any policies we publish on our website or Discord.

If you do not agree to these terms, you must not access or use our services.

2. Eligibility

You must be old enough to use Discord, FiveM, Rockstar Games services, and any payment platform used by our store. By using our services, you represent that you meet the minimum age and legal requirements applicable in your region.

You are responsible for ensuring that your use of the server is lawful where you live.

3. Accounts & Access

Access to the server may require one or more third-party accounts, including but not limited to FiveM / Cfx.re, Rockstar Games, Discord, and our store provider.

• You are responsible for your own account security and any activity performed through your accounts.
• You may not share, sell, transfer, or buy access to server accounts, donor perks, whitelist slots, or staff positions unless we explicitly allow it in writing.
• You may not evade punishments by using alternate accounts, alternate licenses, VPN abuse, or account-sharing.
• We may require verification to restore, transfer, or review access tied to a purchase.

4. Player Conduct

You agree to follow all published server rules, staff instructions, and community standards while using our website, Discord, game server, and store.

• No cheating, exploiting, modding, duplication, menu abuse, bug abuse, or unauthorized automation.
• No harassment, hate speech, threats, doxxing, stalking, or targeted disruption of other players or staff.
• No attempts to crash, overload, reverse engineer, scrape, or interfere with the server, site, or store.
• No chargeback threats, blackmail, extortion, or abusive payment disputes.
• No impersonation of staff, content creators, developers, or other community members.

Staff decisions on live moderation issues are final unless appealed through the channel or process we provide.

5. Store & Purchases

Our store may offer digital perks, supporter packages, queue priority, cosmetic benefits, access flags, or other community-related features. All purchases are for digital, revocable, service-linked benefits only.

• All store benefits are provided on an “as available” basis and may be changed, removed, rebalanced, or discontinued at any time.
• Purchases do not create property rights in any account, character, role, vehicle, item, currency, or server position.
• You may not resell, sublicense, trade, or transfer purchased benefits unless we expressly allow it.
• We may delay, deny, or cancel delivery if we suspect fraud, abuse, platform violations, sanctions issues, or payment risk.
• Store purchases do not guarantee permanent access to the server, Discord, or any future version of the community.

We reserve the right to correct pricing errors, package descriptions, technical mistakes, or accidental grant issues.

6. Refunds & Chargebacks

Unless required by law, all purchases for digital server-related benefits are final and non-refundable once delivered, activated, or applied to your account.

• Refund requests are reviewed case by case and may be denied where the package has already been delivered or used.
• Starting a chargeback or payment dispute without first contacting us may result in immediate suspension or permanent ban from our services.
• If a payment is reversed, disputed, refunded, flagged as fraudulent, or otherwise clawed back, we may revoke any related benefits immediately.
• We may require evidence of purchase ownership before discussing a refund, transfer, or correction.

Nothing in this section limits any non-waivable consumer rights you may have under applicable law.

7. Suspensions & Bans

We may suspend, restrict, revoke, or permanently terminate access to any part of our services at any time for rule violations, suspected fraud, platform-policy concerns, security issues, ban evasion, store abuse, or conduct harmful to the community.

• A ban or restriction does not entitle you to a refund.
• Purchased perks may be removed if your access is suspended or terminated.
• We may wipe progress, inventories, roles, permissions, or linked entitlements where necessary for balance, enforcement, security, or technical maintenance.
• We are not required to provide advance notice before taking moderation or security action.

8. Virtual Items & Ownership

All server content, systems, perks, scripts, branding, roles, configurations, and virtual benefits remain the property of Evergreen State Roleplay or their respective owners and licensors.

You receive, at most, a limited, revocable, non-transferable permission to use server-related features while your account remains in good standing. You do not own any digital item, in-game money, queue priority, role, or other intangible benefit made available through the server or store.

9. Privacy & Data

We may process limited information needed to operate the server and community, such as identifiers from Discord, FiveM / Cfx.re, Rockstar-linked services, IP or connection logs, moderation history, and purchase-related records provided through our store platform.

• We may use this information for moderation, fraud prevention, support, technical administration, enforcement, and community safety.
• We may retain logs and records for legitimate operational, legal, and security purposes.
• Payment information is typically processed by third-party providers and not stored directly by us unless explicitly stated.

By using our services, you consent to this operational processing to the extent permitted by applicable law.

10. Third-Party Services

Our services depend on third-party platforms, including but not limited to FiveM / Cfx.re, Rockstar Games, Discord, and Tebex or another approved store provider. Your use of those services may also be governed by their own terms, privacy notices, and enforcement rules.

We are not responsible for outages, account actions, policy changes, payment holds, regional restrictions, or access loss caused by third-party platforms.

11. Disclaimers

Our services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted uptime, error-free operation, compatibility with every system, delivery times, restoration of lost data, or ongoing availability of any feature, package, or benefit.

We may change gameplay, permissions, economy values, vehicle access, whitelisting methods, package perks, or community structure at any time, with or without notice.

12. Limitation of Liability

To the maximum extent permitted by law, Evergreen State Roleplay, its owners, staff, developers, moderators, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of access, loss of data, loss of digital progress, loss of purchases, loss of goodwill, or service interruptions.

To the extent liability cannot be excluded, our total liability to you for claims arising out of or relating to the services will not exceed the amount you paid to us in the 90 days before the event giving rise to the claim.

13. Changes to Terms

We may update or replace these Terms of Service at any time. Updated terms become effective when posted to this page, unless a different date is stated.

Your continued use of the server, Discord, website, or store after changes are posted constitutes acceptance of the updated terms.
